Below you will find important information on REFUND POLICY and LIABILITY WAIVER POLICY. You will need to acknowledge and agree with both of these before your participation in a workshop or other event hosted by J Günther Photography
RELEASE & WAIVER OF LIABILITY AGREEMENT (ALL Workshops & Tours)
I acknowledge that I have voluntarily agreed to participate in the Workshop offered by J Günther Photography.
There are many instances where my health may be affected such as by natural, human or animal related events and activities which cannot be foreseen and or prevented. Workshops may be conducted in various terrain and environments where hazards may exist.
I AM AWARE THAT THESE ACTIVITIES CAN BE HAZARDOUS AND COULD RESULT IN SERIOUS INJURY OR DEATH. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED, AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY, DEATH OR PROPERTY DAMAGE, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN.
I verify that I understand this statement and that I am 18 years of age or older.
I also agree to participate in these activities and I forever release J Günther Photography, their principals, instructors, guides, and any cooperating agent(s) from any and all actions, claims, or demands that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives now have, or may have in the future, for injury, death, or property damage, related to (i) my participation in these activities, (ii) the negligence or other acts, whether directly connected to these activities or not, and however caused, by J Günther Photography, or (iii) the condition of the premises where these activities occur. I also agree that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach the property of any Releasee in connection with any of the matters covered by the foregoing release.
I release J Günther Photography, their principals, instructors, guides, and any cooperating agent(s) from any liability for any act, error, omission, injury, loss of personal property or expense(s), delay, mishap, or damage to persons or property arising from any cause during the course of the workshop or in transit to, from, and during the workshop.
I also understand that J Günther Photography does not assume any responsibility or obligation to provide financial assistance or other assistance, including, but not limited to, medical, health, or disability insurance, in the event of injury, illness, death, or property damage.
I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND J Günther Photography AND ENTER IT ON MY OWN FREE WILL.
PAYMENT: We use Pay Pal as our payment client. Payment can be made using your credit card or your Pay Pal account. We also accept checks. You are considered enrolled in a workshop when your payment has cleared and funds are deposited with J Günther Photography.
DEPOSIT REFUNDS: A FULL REFUND of your deposit will be made up to 60 days prior to the scheduled workshop. See “CANCELLATIONS” below for more information if you cancel less than 60 days prior to a workshop.
CANCELLATIONS: We work hard to scout and select locations, obtain permits, arrange lodging discounts, and other related expenses. In addition, if there is a cancellation we need to refill that slot. Sometimes there are costs that are unrecoverable.
SINGLE-DAY WORKSHOP/TOURS: *If you need to cancel from a workshop, please notify J Günther Photography at least 3 days prior to the date of your selected workshop. We will refund your registration fee in full (minus credit card transactions fees if any).
If you cancel less than 3 days before the workshop, we will refund your registration fee, minus a 20% cancellation fee. Additionally, due to your cancellation, any unrecoverable costs incurred by J Günther Photography will be billed against your registration fee.
You may apply your already paid fees to a future workshop of equal or greater value if you wish. We will apply those fees toward the future workshop. If that workshop is a greater price, your existing fees will applied and you will owe the remaining value.
*No refund will be made for participant withdrawal after a workshop begins.
MULTI-DAY WORKSHOPS: * If you need to cancel from a workshop, please notify J Günther Photography at least 60 days prior to the date of your selected workshop. We will refund your registration fee in full.
** If you cancel 30 to 59 days before the workshop, we will refund your registration fee, minus a 20% cancellation fee. Additionally, due to your cancellation, any unrecoverable costs incurred by J Günther Photography will be billed against your registration fee.
*** No refund will be made for participant withdrawal less than 30 days prior to or after a workshop begins.
J Günther Photography cannot be responsible for cancellations due exigent circumstances beyond our control. However give us a call and we’ll do our best work things out. In limited circumstances, you may apply your already paid or remaining balance to a future workshop of equal or greater value if you wish. We will apply those fees toward the future workshop. If that workshop is a greater price, your existing fees will applied and you will owe the remaining value.
WEATHER: We do not cancel workshops simply because of inclement weather. Often dramatic weather adds creativity to your images. Certainly if the situation presents dangerous conditions we evaluate and respond accordingly so as not to expose anyone to harm. We strongly recommend travel insurance (see below).
It is highly unlikely that J Günther Photography will cancel a workshop. If we do cancel a workshop, J Günther Photography is not responsible for reimbursement of any travel, lodging, equipment rental or any other related expenses by an attendee and/or his or her sponsor. In order to avoid hardship, we will of course, make every effort possible to notify attendees as soon as possible. We therefore strongly recommend purchasing travel insurance to cover any non-refundable registration fees, travel, lodging, equipment rental or any other related expenses.
If a workshop is canceled by J Günther Photography, all deposited fees (except as stated in the paragraph above) can either be refunded or may be transferred and applied toward another workshop that we have scheduled. If the next workshop is more expensive, your initial amount will be applied to the workshop tuition and you will be billed for the remaining value.
SAFETY & HEALTH CONSIDERATIONS: Our concern is for your safety and that of other participants. J Günther Photography workshops are within the capabilities of average people in good health. At times it is possible yet rare that you will be walking for several miles over uneven trails and occasionally hiking at high elevations — all while carrying an assortment of camera equipment. If you have concerns about your own capabilities and/or fitness as it relates to a trip, please ask us before reserving a space.
Upon deposit of funds for the workshop, you certify that you do not knowingly have any physical or other conditions of disability that would create a risk for you, other trip participants or staff. The instructor(s) judgment shall provide the ultimate determination of an individual’s ability to embark upon or to continue a trip. Once a trip has been confirmed, medical circumstances will not be considered as exceptions to our cancellation policy.
We assume no responsibility for medical care or for special dietary requirements. Please let us know if you have any concerns.
INSURANCE: All participants are strongly urged to purchase travel protection insurance. As well, you should have the appropriate medical and automobile insurances (if applicable) when attending our workshop.
